We also collect, use and share Aggregated Data such as statistical or demographic data for any purpose. Aggregated Data may be derived from Users personal data but is not considered personal data as this data does not directly or indirectly reveal a User’s identity. For example, we may aggregate Users Usage Data to calculate the percentage of users accessing a specific website feature. However, if we combine or connect Aggregated Data with a User’s personal data so that it can directly or indirectly identify a User, we treat the combined data as personal data which will be used in accordance with this privacy notice.

COOKIES AND SIMILAR TECHNOLOGIES

Google Analytics & Google AdWords Remarketing

Mode Society use Analytics Remarketing with Google Analytics, and AdWords Remarketing with Google AdWords to advertise online. Third-party vendors, including Google, may show Mode Society ads on sites across the Internet. This could mean that we advertise to previous Users who haven’t completed a task on our site, for example using the contact form to make an inquiry. This could be in the form of an advertisement on the Google search results page, or a site in the Google Display Network. Third-party vendors, including Google, use cookies to serve ads based on a User’s past visits to the Mode Society Website.

Mode Society and third-party vendors, including Google, use first-party cookies (such as the Google Analytics cookie) and third-party cookies (such as the DoubleClick cookie) together to inform, optimize, and serve ads based on a User’s past visits to our website, and to report how our ad impressions, other uses of ad services, and interactions with these ad impressions and ad services are related to visits to our site. Unless specified otherwise, Personal Information and Data requested when using our website is voluntary, which means that it is not a statutory or contractual requirement, or a requirement necessary to enter into a contract. Users are free not to provide such Personal Information and Data without consequences to the availability or the functioning of our Website or the Services. Where the provision of Personal Information and Data is mandatory, such a requirement is stated. In that case, failure to provide such Personal Information and/or Data may make it impossible for the Website to work properly or for us to provide any Services to Users.

Request Access To Your Personal Data

Users have the right to obtain a copy of the personal data we hold about them and certain information relating to our processing of User’s personal data.

Request Correction Of Your Personal Data

Users are entitled to have their personal data corrected if it is inaccurate or incomplete. Users can update your personal data at any time by logging into their account and updating their details directly, or by emailing us at privacy@mode-society.com.

Request Erasure Of Your Personal Data

This enables Users to request that Mode Society delete their personal data, where there is no good reason for us continuing to process it. Note, however, that we may not always be able to comply with a Users request of erasure for specific legal reasons which will be notified to the User, if applicable, at the time of their request.

Request Restriction Of Processing Of Your Personal Data

Users have a right to ask Mode Society to suspend the processing of their personal data in certain scenarios, for example if a User want’s us to establish the accuracy of the data, or a User’s has objected to our use of their data but we need to verify whether we have overriding legitimate grounds to use it. Where processing is restricted, we are allowed to retain sufficient information about a User to ensure that the restriction is respected in future.

Request The Transfer Of Your Personal Data

Users have the right to obtain a digital copy of their personal data or request the transfer of their personal data to another company. Please note though that this right only applies to automated data which the User initially provided consent for us to use or where we used the data to perform a contract with them.

Object To Processing Of Your Personal Data

Users have the right to object to the processing of their personal data where we believe we have a legitimate interest in processing it (as explained above). Users also have the right to object to our processing of their personal data for direct marketing purposes. When may send User’s marketing communications, if and when:

ADVERTISING

We LOVE putting ourselves and our brand's out there to keep our Users up to date on our latest initiatives, and product offering. We do this through advertising. How we do this is we try to target Users, “the customer”, with our banners and adverts. Even when Users are using other websites and services not associated with us. Like many companies, we may target Mode Society banners and ads to Users when they use other websites and apps, based on the Contact, Technical, Usage and Profile information and data. We do this using a variety of digital marketing networks and ad exchanges, and a range of advertising technologies such as web beacons, pixels, ad tags, cookies, and mobile identifiers, as well as specific services offered by some sites and social networks, such as Facebook’s Custom Audience Service.

USERS PREFERANCES AND CHOICES

We want Users to be comfortable with the information and data we collect and use, therefore, we strive to provide Users with having control regarding the personal information and preferences Users provide to us. We have created mechanisms to provide Users with the following control over their information:

Tracking Technologies And Advertising

Users can set their browser to refuse all or some browser cookies, or to alert them when cookies are being sent. If Users disable or refuse cookies, please note that some parts of this site may become inaccessible or not function properly.

Marketing And Promotional Offers

If Users do not wish to have their email address/contact information used by Mode Society to promote our own or third parties’ products or services:

  • Users can ‘opt-out’ by unchecking the relevant box located on the Contact Information form during the checkout process.
  • Users account holders may withdraw their consent by simply logging in to their Account and editing their ‘Contact Preferences’.
  • Users can unsubscribe or ‘opt-out’ from receiving marketing messages, they can unsubscribe from the link in one of our email messages or reply “STOP” for SMS. This opt-out does not apply to information provided to Mode Society as a result of a product purchase, warranty registration, product service experience or other transactions.

We will process all opt-out requests as soon as possible, but please note that due to the nature of our IT systems and servers it may take a few days for any opt-out request to be implemented.

Non-Promotional Purposes

If Users have opted out of receiving marketing or promotional communications from us, we may still contact them for transactional or informational purposes (such as for customer service). We may also still contact Users to comply with our legal or other compliance obligations.

Text Marketing And Notifications

When Users enter their phone number in the checkout and initializing a purchase, subscribing via our subscription form or a keyword, Users agree that we may send them text notifications (for the Users order, including abandoned cart reminders) and text marketing offers. Text marketing messages will not exceed 30 a month. Users acknowledge that consent is not a condition for any purchase.

If Users wish to unsubscribe from receiving text marketing messages and notifications reply with STOP to any mobile message sent from us or use the unsubscribe link, we provided Users within any of our messages. Users understand and agree that alternative methods of opting out, such as using alternative words or requests will not be accounted as a reasonable means of opting out. Message and data rates may apply.

ACCESSING AND CORRECTING INFORMATION.

Users can review and change their personal information by logging into the Website and visiting their account profile page.

Users may also email us at; privacy@mode-society.com to request access to, correct or delete any personal information and data, that Users have provided to us. Please note that we are not able to delete a User’s personal information and data, without also deleting their account.

We may not accommodate a request to change information, if we believe the change would violate any laws or legal requirement or cause the information to be incorrect.

If Users delete their user Contributions from the Website, copies of their user Contributions may remain viewable in cached and archived pages and/or might have been copied or stored by other Website users. Proper access and use of information provided on the Website, including user Contributions, is governed by our terms of use.
